Deposit Protected Late? You May Still Claim
Yes, you may still be able to claim: protecting it after the 30-day deadline does not undo the breach.

In Short
Yes, you may still be able to claim if your landlord protected your deposit late. The law gives them 30 days from receiving it to protect it and give you the prescribed information. Since 2012, protecting it after that deadline does not undo the breach, so late protection is not a defence. A court must award between 1x and 3x the deposit if the rules were broken.
Sam's Deposit: An Example
- 3 MarchSam pays a £1,100 deposit
- Day 30The deadline to protect it passes
- 22 AprilProtected and paperwork sent, 51 days in
- The ResultA court would have to award £1,100 to £3,300
Was Yours Late? Check Two Dates
- When You PaidYour bank statement, receipt or tenancy agreement shows this.
- When It Was ProtectedOn the certificate, or search the scheme.
- Count The GapMore than 30 days, counting the payment day as day one? It was late.
How Late It Was Affects The Amount
- A few days late
- All the paperwork given
- Fixed as soon as spotted
- Months or years late
- Only fixed once challenged
- A professional landlord or agent
Why The Law Changed
In 2010 a court said late protection could get a landlord off the hook. Parliament reversed that. Since 6 April 2012, what matters is whether the landlord did it within 30 days, not whether they fixed it later.

Quick Answers
Can I Claim If My Deposit Was Protected Late?
Yes, you may be able to. Since April 2012 a landlord who protects a deposit after the 30-day deadline can still be ordered to pay one to three times the deposit.
How Do I Know If It Was Protected Late?
Compare the date you paid, from your bank statement or receipt, with the protection date on your certificate or the scheme search. More than 30 days apart means late.
Does Late Prescribed Information Count?
Yes. Giving the prescribed information late, or not at all, is a separate breach even if the deposit was protected on time.
Will Late Protection Reduce My Compensation?
It may. A landlord who fixed the mistake quickly may get a lower award than one who never protected the deposit.
